Our team succeeded in obtaining an order granting summary judgment in this complex negligent security/wrongful death case. The Plaintiff alleged that our client, a national big box retailer, was liable for the death of an individual who was killed in their parking lot by a third party, claiming the retailer failed to provide adequate security and maintain a safe premises. Despite allegations of a high-crime area, our team built a winning defense establishing that the decedent was an uninvited licensee on the property at the time of the incident and that the violent attack was entirely unforeseeable, with only one prior violent crime in the vicinity in the five years preceding the incident. The Court agreed that no evidence of negligence existed and that Florida law does not make a proprietor an insurer of patron safety.
