Plaintiff Richard Matthews filed suit in the United States District Court for the Virgin Islands, Division of St. Croix, asserting claims against multiple defendants, including four physician defendants. The physician defendants moved to dismiss all claims asserted against them — or in the alternative, for severance — arguing the Court lacked subject matter jurisdiction over those claims. Magistrate Judge Emile A. Henderson III issued a Report and Recommendation on August 21, 2024, recommending dismissal under Rule 12(b)(1) of the Federal Rules of Civil Procedure. Plaintiff filed timely objections, which purported to raise new factual allegations and sought leave to refile a claim under 42 U.S.C. § 1983, but failed to address the legal basis for the Magistrate Judge’s recommendation or present any supporting legal authority. Chief Judge Robert A. Molloy conducted a de novo review of the full record, overruled Plaintiff’s objections as without merit, and on March 31, 2026, adopted the Report and Recommendation in its entirety. All claims against the four physician defendants were dismissed for lack of jurisdiction, and the case was terminated as to them. Chivonne Thomas and Tracy Myers represented the physician defendants and secured the complete dismissal.
