In the Circuit Court of the Eleventh Judicial Circuit In and For Miami-Dade County, Florida

Plaintiff alleged he was falsely arrested while he was shopping at a big box retailer in Miami, Florida. He claimed that he suffered physical injuries as a result of being placed in a police car for an extended period of time, following his detention by store employees. The big box retailer moved for summary judgment. The Court found that the Plaintiff passed all points of sale with merchandise that he had not paid for, and voluntarily signed a statement that he intended to deprive the store of the merchandise. The Plaintiff claimed cervical injuries and underwent surgery. The Plaintiff sought over $200,000 in damages. Audra Bryant was the lawyer for HM&B who secured a complete summary judgment. As a result of an expired Proposal for Settlement, attorney fees and costs will be sought.
