Plaintiff claimed that she was permanently injured when her SUV was rear ended by the Defendant’s motorcycle at the on-ramp entrance to the Florida Turnpike in Broward County, Florida. As a result of the accident, she claimed that she injured her right shoulder which required surgery and sustained injuries to her neck and back. In addition, she claimed that she was a “sheltered employee” and would not be able to seek gainful employment due to her injuries from anyone else but her current employer (who accommodated her limitations). Ms. Moreau’s husband also asserted a loss of consortium claim. The defense admitted liability and the case proceeded to trial on the issue of damages only. Plaintiff’s counsel asked the jury to award his clients damages in the high six figure range. After 15 minutes of deliberations, the jury agreed with the defense and awarded her emergency room treatment bills only which resulted in a defense verdict after the PIP set off. A Proposal for Settlement was filed in the case and due to the defense verdict, post-trial motions will be filed seeking attorneys’ fees and costs.
