HM&B Secures Summary Judgment Win in Case Involving Trip & Fall at Home Improvement Retailer

John Doe v. Home Improvement Retailer

Plaintiff alleges she was injured when she tripped and fell on a cable that was securing lawn equipment together. After Plaintiff fell, she was able to identify what caused her incident and identified a silver cable which was plainly visible. Plaintiff testified that the area was brightly illuminated because it was sunny outside. The Court found that any objectively reasonable person would expect large, expensive lawn equipment to be secured with chains and/or cables to prevent theft and would use extra caution and be vigilant when walking around, through, or near such equipment. The Court reasoned that the color of the cable is immaterial where the cable was positioned six inches above the ground.
