Plaintiff alleges that he tripped and fell over the black base of a caution cone at the entrance of the retailer’s store. He contends that although the retailer had blocked off the area with a large caution cone featuring a black base and yellow warning flags, this did not provide adequate notice/warning because the base blended into the black concrete. Plaintiff asserts that by using a caution cone with a black base, the retailer created the hazardous condition. He claimed significant permanent injuries as a result. The entire incident was captured on video. The Motion was handled by Schuyler Smith and Shaunda Hill.
