Plaintiff alleged that she was injured when she slipped and fell on what she contended was dirt/grime in one of the aisles of our client’s store. Plaintiff claimed that the store failed to maintain the store in a reasonably safe condition and failed to warn her of the presence of the dirt/grime on the floor. The court granted summary judgment in favor of the retailer finding that it did not have actual or constructive notice of the existence of the dirt/grime. As a result of this ruling, all claims against HM&B’s client have been dismissed, and final judgment has been entered in favor of our client. The motion was written by Michael J. Dono and Bradley A.
