HM&B Secures Five Motions for Summary Judgement in One Case

Plaintiff Walsh alleged that his roof and the interior of his home were damaged as the result of a wind storm. Plaintiff did not report the claim for several months after the alleged storm that caused the damage. Additionally, the date of loss alleged in the Complaint was not the date of loss reported to Defendant when the claim was initially reported. Defendant asserted several affirmative defenses which ultimately formed the basis for six motions for summary judgment in defense of Plaintiff’s claim. At a three hour, evidentiary hearing on Defendant’s Motions for Summary Judgment, Nikki Hawkins presented the Court with the evidence and documentation in support of Defendant’s six motions for summary judgment. The Court granted five of the six summary judgment and denied Plaintiff’s motion for rehearing/reconsideration. Defendant served both a Proposal for Settlement and Motion for Sanctions in accordance with FS 57.105 in order to recover fees and costs in defense of this non-meritorious case.
