Hamilton, Miller & Birthisel, LLP secured an outstanding defense verdict following a hard-fought two-week jury trial against Morgan & Morgan arising from a high-speed collision between a passenger vehicle and a tractor trailer traveling approximately 63 mph. The plaintiff alleged catastrophic injuries, including a severe traumatic brain injury, multiple fractures requiring internal fixation, internal organ damage, a prolonged coma, more than 20 surgical procedures, and long-term psychological conditions. Based on these claims, plaintiff’s counsel asked the jury to award a staggering $137 million in damages. Despite the severity of the allegations, the HMB trial team aggressively challenged liability from the outset, maintaining that the accident was caused by the plaintiff. In closing arguments, the defense emphasized the evidentiary weaknesses in the plaintiff’s case and argued that any damages, if awarded at all, should not exceed $1.3 million. The jury returned a $1 million verdict, delivering an exceptional outcome that reflects the strength of the defense strategy, trial preparation, and courtroom execution. Most importantly, the client was extremely pleased with the result.
