HM&B Secures a Complete Defense Verdict in 4-Day Premises Liability Trial

John Doe V. Big Box In the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida

Plaintiff alleged injuries arising from an incident at Defendants’ warehouse-style store after being splashed with cleaning products upon coming into contact with a store display. Plaintiff further claimed that, after proceeding to the restroom to clean off his leg, he slipped and fell, sustaining additional injuries. Plaintiff contended that Defendants failed to maintain the premises in a reasonably safe condition, failed to properly inspect, secure, or warn of the alleged hazardous condition involving cleaning products displayed in the store, and failed to maintain the restroom in a reasonably safe condition. Plaintiff further alleged that, as a result of the incident, he sustained significant personal injuries requiring medical treatment. Plaintiff sought over $614,000.00 in damages, including more than $114,000.00 in past medical expenses. Plaintiff claimed various injuries as a result of the incident, including injuries that ultimately resulted in a knee arthroscopy, and sought compensation for medical expenses, pain and suffering, and other alleged losses. Following a four-day trial, Samantha S. Loveland and Stefanie Gonzalez, serving as trial counsel for Defendants, secured a complete defense verdict on behalf of their client.
