HM&B Secures a Complete Defense Verdict for Insured in a Premises Liability Suit by Way of a Motion for Summary Judgements on Workers’ Compensation Immunity Grounds

The Court granted the Motion for Summary Judgment in full, sustaining the workers’ compensation immunity objections. In its ruling, the Court found that the undisputed facts establish that the Plaintiff was injured in the course and scope of her employment at the time of the workplace accident, that workers’ compensation coverage was in place, and that Plaintiff proved no exception to employer immunity despite arguments from Plaintiff that the Employer was being sued in their personal capacity as landowners and not in their capacity as the employers of the Plaintiff.
