The Court granted Defendant’s Motion for Summary Judgment, finding that the plaintiff could not establish actual or constructive notice of the transitory substance under Fla. Stat. § 768.0755, and that the liquid being on the ground for four minutes was insufficient as a matter of law. In reaching this conclusion, the Court relied on established Florida precedent and emphasized the plaintiff’s lack of record evidence or case law to support her position. Plaintiff sought to delay the hearing with a motion to continue but the Court enforced the deadlines and rejected those efforts. The Court agreed that the record evidence did not establish actual or constructive notice. A good reminder of the power of a well-developed record and the importance of holding firm to the rules.
