HM&B Wins Summary Judgment in $25M Claim Against Major Cruise Line


We are delighted to share that our team recently achieved a significant victory for one of our clients, a major cruise line, in a high-stakes negligence case. The lawsuit, which had been pending since 2018, was brought against the cruise line by a plaintiff seeking damages of $25 million for injuries allegedly sustained after the voyage had ended and after the plaintiff had debarked the ship.

Our legal team successfully defended the cruise line against these claims, ultimately persuading the Court to grant summary judgment in favor of our client. Specifically, the Court found that the cruise line had no duty to the plaintiff as the cruise had ended, the cruise line did not have notice of any dangerous condition, there was no duty to warn of any dangerous condition, and the condition complained of was open and obvious. Furthermore, the Court found that there was no proximate cause between the cruise line’s alleged conduct and the plaintiff’s injuries.
