HM&B Secures Defense Verdict for Big Box Retailer after 5-Day Trial Involving Admitted Liability

Michelle McCormack v. Wal-Mart Stores East, LP

Case No. 50-2020-CA-003091 (In the Circuit Court of the 15th Judicial Circuit in and for Palm Beach Count, Florida)

Plaintiff, Michelle McCormack, alleges she was injured when she slipped on a squished grape on the floor near the self-checkout register at a Wal-Mart store in Palm Beach County. Ms. McCormack did not fall, but claimed that the “slip and twist” resulted in injuries to her lower back requiring surgery. Wal-Mart admitted liability for the grape being on the floor, but denied that Plaintiff’s incident caused any injury to her. Plaintiff sought over $1.5 million dollars in damages, which included over $200k in past medical expenses. After five (5) days of trial, the jury agreed with Wal-Mart and returned a defense verdict in Wal-Mart’s favor. Stephanie H. Vo and Suzette L.
