HM&B secured a defense verdict for a cruise line after a five (5) day arbitration. Claimant, a crew member from Costa Rica, alleged he was injured when he was lifting a heavy night stand on a cruise ship. Claimant asserted the cruise line was negligent for failing to provide proper training, failing to provide the proper amount of crew members to perform his duties, failing to provide prompt, proper and adequate medical care, and failing to provide maintenance and cure. After five (5) days of arbitration, the arbitrator granted a defense award noting there was no negligence, there was no failure to provide adequate medical care and overtime wages and also denied the claim for past maintenance and cure. Claimant sought over $1.7 million in damages. Congrats to our partner William F. Clair and the HMB Team who secured the defense verdict for the cruise line.
