The trial team of Jerry Hamilton and Jeanette Bellon were able to obtain a defense verdict in 31 minutes for its client, Joe’s Crab Shack, in a week long trial in Naples, Florida on February 6, 2015. The Plaintiff claimed that he suffered back, hip and knee injuries when his chair collapsed in a drain hole that did not have a secure cover. Plaintiff had multiple surgeries which he asserted were related to the accident. Plaintiff sought and asked the jury for over 1 million dollars in damages. Joe’s Crab Shack was able to establish that, not only was its restaurant reasonably safe but also that the Plaintiff’s injuries were not causally related to the incident at Joe’s. After a hard fought trial, a jury of 3 men and 3 women came back with a complete defense verdict. The next step is for Joe’s to secure its attorney’s fees and costs. It is unknown whether Plaintiff will be taking an appeal.
