Partner Jules Massee and Associate Whittni Parks of the Tampa Office recently obtained summary judgment on behalf of their client, a trucking broker.  The Plaintiff, a shipper, alleged the trucking broker breached its contract by failing to obtain a reliable, insured carrier for its intrastate shipment of goods.  The Plaintiff’s goods were stolen in transit.  HMB argued Plaintiff had put forth no evidence regarding the existence of a contract.  The Plaintiff claimed the parties’ past business relationship supported the contract’s formation, but failed to identify any specific exchanges, conversations, or documents that demonstrated any agreed terms or conditions.  The Court sided with HMB, finding no evidence of a contract to support Plaintiff’s claims, and entered summary judgment in the trucking broker’s favor.
