Paxton Bagan is an associate in the firm’s Miami Office. Paxton is a trial attorney who focuses his practice in the areas of commercial litigation, personal injury and premises liability defense. He is a skilled and zealous advocate for his clients.

Prior to joining Hamilton, Miller & Birthisel, Paxton spent his career representing a variety of clients ranging from individuals and small businesses to large corporations and insurance companies. He has litigated and argued motions before circuit court judges throughout a number of Florida’s judicial circuits mainly focusing on Miami-Dade, Broward, and Palm Beach County.

Paxton was born and raised in Fort Lauderdale, Florida, and earned his undergraduate degree from the University of Central Florida. He received his Juris Doctor from Golden Gate University School of Law where he worked tirelessly in the Veterans Legal Advocacy Center, supporting veterans wishing to  upgrade their discharge status to receive better benefits.

J.D., Dean’s List, Golden Gate University School of Law

  • Spent 3 semesters participating in the Veterans Legal Advocacy Center, which is a pro-bono legal clinic that my law school ran which specialized in helping veterans who received a less than honorable discharge apply for a discharge upgrade. Veterans can receive a less than honorable discharge for numerous reasons, usually which are not their fault, and a less than honorable discharge drastically reduces the benefits these veterans are entitled to received.

B.S., University of Central Florida

  • Assisted in obtaining summary judgment in a premises liability slip-and-fall case where plaintiff alleged notice of a foreign transitory substance and lack of adequate grocery store inspection. The Court agreed that plaintiff’s theory was based on speculation and held that unsupported inferences cannot establish constructive notice under Florida law.
  • Assisted in obtaining order granting summary judgment in slip and fall case brought by Bogin Munns & Munns, based upon the lack of evidence that the grocery store where this occurred was on notice of the transitory foreign substance in accordance with F.S. 768.0755
  • Assisted in obtaining order granting summary judgment in slip and fall case brought by Morgan & Morgan, based upon the lack of evidence that the grocery store where this occurred was on notice of the transitory foreign substance in accordance with F.S. 768.0755
