Plaintiff alleges that she fell, sustaining injuries, after she leaned on a bright yellow vinyl tarp that separated two rooms at a children’s entertainment and party venue. Plaintiff argued that the premises was not maintained because the vinyl tarp had broken straps that connected the vinyl tarp the wall. The Plaintiff did not provide competent evidence that there were broken straps or that they would have prevented the fall. The Court found that there was no evidence of a dangerous condition associated with a the vinyl tarp, and no reasonable juror could find that that the yellow vinyl tarp was a wall.
