Jorge Gomez, Nivia Gomez, Herberto Gomez, and Aida Gomez v. Citizens Property Insurance Corporation

Mike Bradford and Julie Cunningham Aiello of HM&B’s Tampa Office obtained a jury verdict in favor of the Defendant, Citizens Property Insurance Corporation (“Citizens”), on a first party property damage breach of contract case in Miami-Dade County, Florida. The Plaintiffs argued Citizens breached its contract of insurance by failing to pay for damage their property allegedly sustained when a neighboring home exploded from the illegal use of a hydroponics lab used to grow marijuana. Despite the allegations that the house sustained significant damage as a result of the explosion, the jury returned a verdict in favor of the Defendant, determining the alleged damage was not caused by the explosion at the neighboring home, and therefore, was not a covered loss under the policy of insurance. This is the second case the team tried in this series of explosion cases.
