HMB Achieves Di Minimis Settlement at Close of Plaintiff’s case at Trial

Southerland v AIIC

CA22-0383 (In the Seventh Judicial Circuit in and for St Johns County, Florida)

Partners Nikki Hawkins and Isabel Andreacchi achieve fantastic win for client in a high stakes First Party Property Trial in St. John’s County, Florida. Plaintiff rested his case and went home.

Plaintiff sued his insurance carrier over a hail/wind storm claim which he claimed required the replacement of his entire roof and payment for interior damages. After Defendant’s vigorous attack of Plaintiff’s witnesses, and as he closed his case in chief, Plaintiff requested to revisit a pretrial settlement offer from Defendant, a quarter of the amount demanded the Friday before Trial.

The client described Ms. Hawkins’ cross-examination of Plaintiff’s expert as “shredding” his testimony and showed the the jury that the facts just didn’t add up. The damages did not occur during the policy period in question. The evidence did not support Plaintiff’s contentions. Through months of diligent work, strategic depositions and trial preparation we exposed the truth.
