Jason L. Scarberry is a partner in the firm’s Miami Office. Jason is a trial attorney who focuses his practice in insurance, negligent security, personal injury and premises liability among many areas.  Jason is a highly skilled litigator whose two decades of experience has made him well-known for his tenacity and effectiveness in defending claims.    

During his long career, Jason has litigated numerous cases representing both defendants and plaintiffs.He started his career at a firm specializing in defending civil rights claims brought under 42 U.S.C. 1983 and tort claims under Florida’s Waiver of Sovereign Immunity Statute.  Since that time, he has handled a wide variety of cases, including negligent security, premises liability, complex coverage issues related to negligence, wrongful death, and property damage claims. His litigation experience includes multiple trials at both the state and federal levels, as well as appellate experience. 

Jason obtained his Bachelor of Science degree at the University of Findlay in Ohio and his Juris Doctor at the University of Richmond.

Experience

  • Successfully defended appeal of the entry of summary judgment in favor of multiple Sheriff’s deputies in Section 1983 case where inmate alleged the use of excessive force, failure to intervene and failure to implement sufficient policies and procedures. Scroggins v. Davis, et. al., 346 Fed. Appx. 504 (11th Cir. 2009).
  • Argued in front of the Eleventh Circuit Court of Appeals in the case of Huebner v. Bradshaw, (case no: 18-12093) on June 11, 2019.
