Herbert A. Hamilton is Of Counsel in the firm’s Kingston office. Mr. Hamilton brings more than thirty five years of legal experience to the Kingston office of Hamilton, Miller & Birthisel. He earned his Master of Arts from the University of Cambridge and his law degree and LL.M. in Taxation from the University of London.

Since 1992, Mr. Hamilton has worked in private practice advising clients in the areas of tax, corporate, and maritime law. He has served as legal counsel to Container Services Limited and the Natural Resources Conservation Authority. He is a seasoned litigator who has represented major cruise lines in cases involving dock damage, vessel collisions and personal injury. He is experienced in handling vessel arrests and has represented yachts owners in various marine issues.

Prior to that, Mr. Hamilton had a distinguished career in public service including his work as a Revenue Commissioner where he advised the Revenue Board on matters of taxation and represented the Revenue Board in connection with taxation appeals. He also served as a Senior Legal Officer of the Income Tax Department where he prepared legal opinions arising out of objections and refund claims and served as legal adviser to the Commissioners of Income Tax and Stamp Duties with regard to their statutory functions under the Income Tax Act, the Transfer Tax Act, and the Stamp Duty Act. He represented the Commissioner of Income Tax in all appeals before the Revenue Court, Full Court, and Court of Appeals. He has also held legal counsel positions with the Land Valuation Department and the Ministry of Finance.

Mr. Hamilton is admitted to practice law in Jamaica, is a member of the Jamaican Bar Association, the Inner Temple, the Advocates Association, the Royal Jamaica Yacht Club, the Liguanea Club, and a Senior Member of the Inter-American Bar Association.
