Derek B. Barba is a partner in the firm’s Miami office. He is an experienced trial attorney who began his career in personal injury defense and has handled all aspects of litigation including cases involving claims of personal injury from automobile accidents, slip and falls, negligent security, wrongful death, medical malpractice, nursing home/assisted living facility malpractice, insurance coverage issues, third party administration malpractice, fraud/special investigation claims and negligent hiring/retention. Derek has tried over 30 jury trials across South and Central Florida. Derek is fluent in Spanish and has handled multiple cases with Spanish speaking defendants that have gone to trial. Working alongside an assortment of Spanish-speaking clients, as well as employees of his corporate clients has been a strong part of Derek’s practice. Establishing an overall sense of ease and full understanding for his clients during the litigation process is very important–from the initial steps of preparing and advising to case resolution.
A native of Miami, Derek earned his Bachelor’s Degree in English Literature and International & Comparative Studies from the University of Miami and completed his J.D. at St. Thomas University School of Law.

Notable Verdicts and Trial Experience
Obtained a Defense Verdict in a case where 20 year old plaintiff claimed injury to her shoulder from a motor vehicle accident and underwent arthroscopic surgery with no prior history of shoulder trauma. The jury found that no injury caused by the motor vehicle accident.
Obtained a Defense Verdict in a case where the jury found no injury related to the accident where plaintiff was involved in a roll-over motor vehicle accident claiming cervical and lumbar herniated discs.
Obtained a Defense Verdict on liability for defendant’s failure to warn of overhang where the plaintiff drove a truck into an overhang at a high rate of speed and obtained a defense verdict with a finding of no liability.
Defended a slip and fall case where the plaintiff had a fracture of his ankle requiring open reduction internal fixation surgery as well as a second surgery to remove the hardware and obtained a verdict of 50% comparative liability on the plaintiff and reduced the medical expenses whereby the total verdict was $8,000.
Derek has extensive experience defending all aspects of personal injury cases involving individuals and corporations and resolving them to the satisfaction of the clients during the course of discovery, at mediation or if necessary, obtaining a favorable Verdict at trial.
Developed strategy and means to defend cases that involve minimally invasive surgical procedures or percutaneous discectomies/disc decompressions by establishing defense strategies to attack the science as well as the billing under “Letters of Protection” as excessive and unreasonable.
